• You are at least 18 years of age or the age of majority in your jurisdiction
• You have the legal authority to enter into this agreement on behalf of yourself or your business
• You have read, understood, and agree to these Terms in their entirety
• You consent to our Privacy Policy, which is incorporated herein by reference

These Terms apply to all service tiers offered by BuildRev, including the Hands-Off Plan ($347/mo), the Sweet Spot Plan ($497/mo), and the Full Service Plan ($997/mo), as well as any one-time setup fees, promotional offers, or community/newsletter subscriptions.

BuildRev reserves the right to modify these Terms at any time. Continued use of our website or services after modifications constitutes acceptance. We will notify active clients of material changes via email with at least 14 days' notice.

2.1 Permitted Use

You may use the BuildRev website for lawful purposes only, including exploring our services, submitting inquiries, purchasing plans, and accessing client resources. You agree not to:

• Use the website in any way that violates applicable federal, state, or local law or regulation
• Attempt to gain unauthorized access to any portion of the website or its related systems
• Transmit any unsolicited commercial communications (spam) through or in connection with the website
• Introduce any malware, viruses, or other harmful code
• Scrape, crawl, or harvest data from the website without prior written consent
• Misrepresent your identity or affiliation with any person or organization

2.2 Account and Form Submissions

By submitting any form on the BuildRev website, including contact forms, booking requests, quote requests, or newsletter/community sign-ups, you represent that all information provided is accurate, complete, and current. BuildRev is not responsible for service failures resulting from inaccurate information provided by the user.

3.1 Monthly Recurring Subscriptions

BuildRev service plans are offered on a monthly recurring subscription basis. By enrolling in any plan, you authorize BuildRev to charge your provided payment method on a recurring monthly basis until you cancel.

3.2 Setup Fee

A one-time setup fee of $150.00 applies to new clients. This fee is waived for the first 10 qualifying clients during BuildRev's soft-launch promotion. BuildRev reserves the right to modify or discontinue this promotional offer at any time without prior notice.

3.3 Payment Processing

All payments are processed securely through Stripe. By providing your payment information, you authorize BuildRev to charge your account for the applicable plan fees. You are responsible for maintaining accurate and current billing information.

3.4 Cancellation Policy

You may cancel your subscription at any time by providing written notice to BuildRev at least 7 days before your next billing date. There are no long-term contracts. Cancellations are effective at the end of the then-current billing period. No refunds are issued for partial months.

3.5 Non-Payment

In the event of failed payment, BuildRev reserves the right to suspend or terminate service access until the account is brought current. Accounts more than 30 days past due may be permanently terminated.

4.1 BuildRev Ownership

All content on the BuildRev website and within our service deliverables, including but not limited to text, graphics, logos, images, software, templates, automation workflows, chatbot configurations, website designs, dashboard setups, and marketing materials created by BuildRev, are the exclusive intellectual property of BuildRev and are protected by U.S. and international copyright, trademark, and intellectual property laws.

4.2 Limited License to Clients

Upon full payment and for the duration of your active subscription, BuildRev grants you a limited, non-exclusive, non-transferable license to use the deliverables created for your specific business account. This license terminates immediately upon cancellation or non-payment.

4.3 Client-Provided Content

You retain ownership of all content, logos, images, and materials you provide to BuildRev for use in your service delivery. By providing such materials, you grant BuildRev a non-exclusive, royalty-free license to use, reproduce, and display them solely for the purpose of delivering your contracted services.

4.4 Templates and Snapshots

Any website templates, automation snapshots, or digital toolkits offered by BuildRev through its free community, newsletter, or promotional programs remain the intellectual property of BuildRev. Redistribution, resale, or sublicensing of these assets is strictly prohibited without prior written consent.

4.5 Portfolio and Case Study Rights

BuildRev reserves the right to use anonymized or attributed results, screenshots, and performance metrics from client accounts as case studies or portfolio examples for marketing purposes, unless the client requests otherwise in writing.

5.1 Opt-In Consent

By providing your mobile phone number and checking the SMS consent checkbox on any BuildRev form, you expressly consent to receive text messages from BuildRev. Each opt-in is recorded with a timestamp, source page URL, and the exact consent language presented.

5.2 Types of Messages

You may receive the following types of SMS messages from BuildRev:

• Service confirmations, onboarding updates, and appointment reminders
• Account status notifications and billing alerts
• Promotional messages, offers, and marketing communications (where separately consented)
• Responses to inquiries submitted through our website, forms, or chatbot

5.3 Message Frequency and Rates

Message frequency varies based on your plan and activity. Standard message and data rates may apply depending on your mobile carrier. BuildRev is not responsible for carrier charges incurred.

5.4 Opt-Out Instructions

You may opt out of SMS communications at any time by replying STOP to any message from BuildRev. You will receive a single confirmation message confirming your opt-out and no further messages will be sent. To re-subscribe, text START to the same number.

5.5 No Condition on Purchase

Consent to receive SMS messages is never a condition of purchasing any BuildRev product or service. Opting out of SMS will not affect your service delivery or billing.

5.6 No Third-Party Sharing

BuildRev does not sell, rent, or transfer SMS opt-in data or mobile phone numbers to any third party for marketing purposes under any circumstances. This prohibition is absolute and unconditional.

THE BUILDREV WEBSITE AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

BUILDREV DOES NOT WARRANT THAT: (A) THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE; (B) RESULTS OBTAINED FROM USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE; (C) THE QUALITY OF ANY SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED THROUGH THE WEBSITE WILL MEET YOUR EXPECTATIONS.

MARKETING RESULTS, INCLUDING LEAD GENERATION, SALES CONVERSIONS, SOCIAL MEDIA GROWTH, AND SEARCH ENGINE RANKINGS, ARE NOT GUARANTEED AND DEPEND ON NUMEROUS FACTORS OUTSIDE BUILDREV'S CONTROL, INCLUDING MARKET CONDITIONS, INDUSTRY COMPETITION, AND CLIENT RESPONSIVENESS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BUILDREV, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR ANY OTHER INTANGIBLE LOSS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR WEBSITE OR SERVICES.

IN NO EVENT SHALL BUILDREV'S TOTAL CUMULATIVE LIABILITY TO YOU EXCEED THE TOTAL AMOUNT PAID BY YOU TO BUILDREV IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, BUILDREV'S LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

• You grant BuildRev a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, and display Submissions for the purpose of providing and improving services
• You represent that you own or have the right to provide all Submissions and that they do not infringe any third-party intellectual property rights
• BuildRev is not required to maintain confidentiality of any Submissions unless expressly agreed in writing
• BuildRev may use anonymized feedback and testimonials for marketing purposes with your consent

BuildRev reserves the right to remove or decline any Submission that violates these Terms, applicable law, or BuildRev's community standards.

• BuildRev does not endorse or assume responsibility for the content, privacy practices, or terms of any third-party website or service
• Your use of any third-party platform is governed by that platform's own terms and privacy policy
• BuildRev is not liable for any damages or losses arising from your use of third-party services
• Third-party platforms used to deliver BuildRev services (e.g., GoHighLevel) may have their own data processing agreements and terms that apply to your use

We recommend reviewing the terms and privacy policies of any third-party service you use in connection with BuildRev.

10.1 Service Modifications

BuildRev reserves the right to modify, suspend, discontinue, or update any aspect of its services, plans, pricing, or features at any time. Where practical, we will provide at least 30 days' notice to active clients before material service changes take effect.

10.2 Pricing Changes

BuildRev may adjust pricing for service plans with a minimum of 30 days' written notice to active subscribers. Continued use of services after the effective date of a price change constitutes acceptance of the new pricing.

10.3 Terms Modifications

BuildRev may update these Terms at any time. The most current version will always be available at buildrev.tech/terms. For active clients, material changes will be communicated via email with at least 14 days' notice prior to taking effect.

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to its conflict of law principles. You agree that any dispute arising from or related to these Terms or your use of BuildRev services shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida.

11.2 Informal Resolution

Before initiating any formal legal proceedings, both parties agree to attempt to resolve disputes informally by contacting BuildRev at support@buildrev.tech. BuildRev will make reasonable efforts to resolve the matter within 30 days.

11.3 Arbitration

If informal resolution fails, any unresolved dispute shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA), with arbitration conducted in Florida. The decision of the arbitrator shall be final and binding. Class action lawsuits and class-wide arbitration are expressly waived.

11.4 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

NOTE: The checkbox must be unchecked by default. Users must actively select it. Pre-checked boxes are not A2P compliant and may result in carrier filtering or TCPA violations.

• Your use of the BuildRev website or services in violation of these Terms
• Your violation of any applicable law or regulation
• Your infringement of any third-party intellectual property, privacy, or other rights
• Any content or materials you submit to BuildRev that cause harm to a third party
